Miller Rentals on Amelia

Please read the terms and conditions carefully before you begin your vacation.

Any monies received by Miller Rentals on Amelia for occupancy of vacation property indicated the acceptance of the terms of our vacation rental agreement in full. All policies are strictly enforced. It is the responsibility of all guests and members of their party to be familiar with all policies pertaining to rental.

Terms include a No Tolerance Policy regarding excessive noise, parties, or disturbing neighbors. Please make sure you are comfortable with our Terms as they are strictly enforced.

RESERVATIONS: 
All Reservations are subject to Management and Property Owner approval. Online rates are subject to change without notice. Should there be ANY issues with the reservation, you will be contacted within 48 hours.

PROPERTY: 
Guest rents, for vacation purposes only, the furnished real property and improvements described.

FREE INTERNET:
Some properties have complimentary internet services available. These services are contracted with and provided by a third party therefore, we do not have control of the quality or availability of this service. The service is not guaranteed and will not warrant discounts or emergency services. 

ARRIVAL & DEPARTURE: 
Check-in time is no earlier than 4:00 PM on arrival date. This time may be delayed should unforeseen circumstances arise. Check-out time is NO LATER than 10:00 AM on the departure date. Early Check In and Late Check Out options are available for an additional fee if available. If Early Check and/or Late check out are approved you will get a email confirmation from the reservation team.

UNAVAILABILITY: 
For any reason beyond the control of Management, the Premises become unavailable, Management may substitute a comparable unit or cancel this Agreement and refund in full all payments made by Guest.


TRAVEL PROTECTION
Travel protection has been made available with your reservation. The Plan includes coverage for the loss of your prepaid, non-refundable trip costs if your trip is canceled or interrupted due to certain unforeseeable events. We offer travel protection as a way for you to help protect yourself and your trip investment. Outstanding reservation costs are not eligible for reimbursement at the time of cancellation and the cost of The Plan is not eligible for a full refund outside of The Plan’s free look period. Terms and conditions apply; please read your Plan documents carefully and contact Generali Global Assistance with coverage questions.

 
RENTER REQUIREMENTS:
For legal and accounting purposes, the person placing the reservation must be the same as the credit/debit card holder. This person is considered to be the guest. All other persons involved with the rental are considered to be the guest's invitees, and all discussion regarding reservation, cancellation, and damage policies will be discussed with the guest, not the guest's invitees. 

PAYMENT:
The RESERVATION DEPOSIT IS 50% of the TOTAL RENT AMOUNT and is due at booking. Final 50% payment is due 30 days prior to arrival. Full reservation payment is due at the time of booking if the arrival date is 30 days or less from date of booking. NO REFUNDS FOR EARLY DEPARTURES. 

DAMAGE WAIVER FEE/ DAMAGES/ MISSING ITEMS:
A $70 non-refundable Damage Waiver Fee is required for all reservations and is included in the Transaction Fee. The Damage Waiver Fee covers reported accidental or inadvertent damages to the property or maintenance issues. The Guest must notify Miller Rentals on Amelia within two (2) hours of arrival (if you arrive after hours, report to the office the next business day). If accidental or inadvertent damages occur during the rental period, the Guest must notify Miller Rentals on Amelia in writing within twenty-four (24) hours of the incident to be eligible for coverage.
The Damage Waiver Fee does NOT cover the following:

  • Intentional damages caused by Guest or Guest’s invitees
  • Theft by Guest or Guest’s invitees
  • Willful or gross negligent behavior by Guest or Guest’s invitees
  • Removal of items from the property, including moving items to another property, by Guest or Guest’s invitees
  • Unauthorized entry into the homeowner’s closet by Guest or Guest’s invitees
  • Unauthorized animals (excludes lawful service animals) brought into the rental property by Guest or Guest’s invitees
  • Breach of any Rental Policies and Rental Agreements, including but not limited to, any fines imposed on Miller Rentals on Amelia or on the homeowner imposed by any condominium or homeowner’s association, or any governmental or regulatory entity as a result of any violation of law, ordinance, rule or regulation
  • Extensive cleaning required at check-out caused by Guest or Guest’s invitees
  • Damages as a result of smoking by Guest or Guest’s invitees
  • Damages incurred as a result of excess occupancy or parking limits by Guest or Guest’s invitees -or-
  • Any other fines levied against the Guest or Guest’s invitees

The Damage Waiver Fee is null and void upon Guest’s departure and any unreported damages discovered by Miller Rentals on Amelia will be the sole responsibility of Guest. All unreported or non-covered damages will be processed onto the Guest’s credit card on file. Previously listed items and additional charges exceeding the amount covered will be dealt with through conventional means of charging the Guest’s credit card on file for the amount of exceeded damages or replacement costs. The Guest will be notified in writing of any excess damage. If the Guest fails to pay the amount due to Miller Rentals on Amelia for unreported damages, Miller Rentals on Amelia reserves the right to exercise any legal rights available to pursue the amount owed from the Guest. This Damage Waiver Fee is provided by and administered by Miller Rentals on Amelia and is NOT an insurance policy. 

UPON ARRIVAL:
If there are concerns or issues with your rental property, please immediately contact our office (leave a message if there is no answer). No refunds or considerations are given unless we are notified of problems during your stay.

EMERGNCIES/MAINTENANCE:
In the event of a problem getting in the vacation rental or if there are problems with condition or functionality of the vacation rental, please immediately contact the Miller Rentals on Amelia office (leave a voice message if there is no answer!) at 904.328.7924. If it is after office hours we will make every effort to return your call as soon as possible.

ARRIVAL TIME:
Check in is at 4:00pm unless otherwise stated on your check-in instructions. An early arrival may be arranged, pending other reservations and the housekeeping schedule. Please contact us prior to your arrival to make these arrangements. Unless you have specifically arranged for an early arrival time, please do not arrive at the property before your schedule check in time.

DEPARTURE TIME:
Check out is at 10:00AM unless otherwise stated on your check-in instructions. Your prompt departure is appreciated so we can prepare the vacation rental for any incoming guests. A late departure may be arranged, pending other reservations and the housekeeping schedule. If you have not arranged for a late check out, you may be charged a fee for each hour beyond 11 am you are still on property, at a minimum of one hour. 

CANCELLATIONS:
Power/ weather related cancellation: Miller Rentals on Amelia does not issue refunds due to acts of nature such as: weather, road conditions, snow conditions, power outages or forest fires. Reservations will be considered confirmed upon receipt of the 50% initial payment along with review and acceptance of these Terms & Conditions. A valid Credit Card number on file is required on all reservations. IF RESERVATION IS CANCELED WITH LESS THAN 30-DAY NOTICE THE ENTIRE 50% DEPOSIT IS FORFEITED. NO SHOWS OR CANCELLATIONS LESS THAN 15 DAYS PRIOR TO ARRIVAL WILL RESULT IN 100% FORFEITURE OF THE TOTAL RENTAL AMOUNT. NO REFUNDS FOR EARLY DEPARTURE. 

APPROVED GUESTS AND USE: 
The Premises are for the sole use as a personal vacation residence by Approved Guests. Reserving Guest is responsible for any guests that use the property during the term of this agreement. Guest may not exceed the designated Max Occupancy for the Property at any time. If the Premises are used, in any way, by more than max allowed guests, (i) Guest and all others may be required to immediately leave the Premises or be removed from the Premises; (ii) Guest is in breach of this Agreement; and (iii) Guest forfeits its right to return of any monies collected. If there is excessive noise or music, any illegal activity, or evidence of violation of these policies, you may be asked to vacate the premise without any refund and additional charges may be assessed. Please inform us of any change in the number of guests before your arrival to avoid these charges and so the unit can be prepared appropriately for your group.

OCCUPANCY POLICY:
It is the policy of Miller Rentals on Amelia to rent to individuals who are 25 years or older (ID may be required at check-in). We cannot allow a group defined as unrelated adults, high school students, college students, or any other type of situation not meeting the age requirements stipulated herein. Should Miller Rentals on Amelia’s personnel ascertain that a non-qualified group is occupying a property in violation of the age requirement; the group is subject to immediate termination of the agreement with no refund. Miller Rentals on Amelia reserves the right to refuse a requested rental; cancel any existing reservation; refund any deposit already received; and/or terminate current occupancy WITHOUT refund if the occupancy, in our opinion, is detrimental to the property and its owner, whom we represent. 

NO PARTIES: 
All of our rentals are in residential areas and may NOT be used for weddings, receptions, parties, or large gatherings. Any disruptive events could result in the eviction and forfeiture of entire rental amount and security deposit.

ILLEGAL SUBSTANCES: 
No illegal substances are allowed in the rental, and minors should not be in possession of alcohol. Violations will result in eviction from the property and no refunds will be issued.

RULES; REGULATIONS: 
NO COMMERCIAL USE. Guest agrees to comply with any and all rules and regulations that are at any time posted on the Premises or delivered to Guest. Guest shall not, and shall ensure that Guest and licensees of Guest shall not: (i) disturb, annoy, endanger, or interfere with other Guests of the building in which Premises is located or its neighbors; (ii) use the Premises for any commercial or unlawful purpose including, but not limited to, using, manufacturing, selling, storing, or transporting illicit drugs or other contraband; (iii) violate any law or ordinance; or (iv) commit waste or nuisance on or about the Premises.

PETS:
(Does not apply to service animals) PETS ARE ONLY ALLOWED IN THE DESIGNATED “PET FRIENDLY” PROPERTIES. Check your property online or ask an agent to confirm it is Pet Friendly. Pet Friendly properties require a non-refundable pet fee of $150 for nightly rental units or $250 for monthly rental units. Local boarding is available at many local facilities. If pets are found to be present in a NON PET FRIENDLY property, you will be asked to leave, no refund will be given and you will incur a $300 fee. 

LINENS & TOWELS:
Towels, sheets, pillows and blankets are not meant for outside use. An initial set up of trash liners, paper towels, toilet paper and soap is provided. Extra items needed are the responsibility of the guest. Guests are responsible for maintaining the condition of ALL BED & BATH LINENS IN THIS UNIT. 
 
FURNISHINGS:
Each rental property is privately owned and furnished according to the owner’s individual style. Basic equipment and furnishings for a comfortable vacation are provided. If you move furniture while occupying the property, you must return furniture to its original position prior to departure. Failure to comply will result in a $50 fee. 

BEACH TOWELS:
Beach towels may be provided in certain units. Please shake all sand from towels before bringing inside. If towels are left on the beach or not in the unit upon departure, there will be a $25 fee per towel charged to your card.

KEYLESS ENTRY DEVICES:
For your convenience, your unit is equipped with contactless check in using a keyless entry pad on the entry door. This feature works because of a Yale Connect Wi-Fi Bridge that plugs into a power outlet near the smart lock. It uses the home's Wi-Fi and Internet connection to control the lock. This allows us to unlock or lock your door, check your lock's status and receive notifications remotely. To make it easy to identify we have labeled the Yale Connect Wi-Fi Bridge in each unit.
 
Guests are NOT PERMITTED TO UNPLUG THIS DEVICE.  Miller Rentals on Amelia receives notifications when a door lock is disconnected. If a Yale Connect Wi-Fi Bridge becomes disconnected either by accident or temporary loss of WI-FI & guest refuses to cooperate with Miller Rentals on Amelia to reconnect the home's Yale Connect Wi-Fi Bridge, guest will be subject to a $100 RECONNECTION FEE charged to the card on file.

SMOKING:
Smoking is not permitted in any Miller Rentals on Amelia property.  If there is any tobacco smell in the unit after your departure, you will be charged a cleaning fee. Oil lamps and incense are not permitted due to the long-lasting odor. If these policies are violated, there will be a charge for excessive cleaning.

PLUMBNIG:
Do not put any feminine products in the toilet. Plungers are provided if a clog occurs. Please do not pour grease down the drain.

MAIL SERVICES: 
You may ship directly to the home that you are staying in using FedEx or UPS while your are in the home, however we can not guarantee delivery or security of the package. This will be up to the shipping client and the shipping receiver to arrange. **We are not responsible for any lost, damaged or delayed deliveries. Returning late deliveries after a guest has left will incur an additional fee, plus cost of shipping.

SYSTEM(S) FAILURES: 
In the event the rental unit sustains a failure of a system, including but not limited to water, sewer, septic, electrical, gas, plumbing, mechanical, appliances, heat pump, ventilating, pool, hot tub or other system or structural systems, neither the property owner nor the Management shall be liable to Guest for damages, and no refunds will be given for such failures. However, Management will make an effort to promptly repair or replace the failed system or equipment, and in such event, Guest agrees to permit Manager or its service provider to have reasonable access to the property to inspect and make such repairs.

POOL AND SPA: 
If so equipped, Guest understands that the area surrounding pool and spa may not be fenced or secure. Guest understands and agrees to be responsible and liable for any damages that occur to the pool and spa and its support equipment through Guest misuse and/or negligence.

SECURITY & SAFETY RISKS:
Always lock doors and windows when you leave the vacation rental! When you rent the vacation rental, you assume responsibility for it and its contents, as well as your personal property. Always lock the doors and windows when you leave the vacation rental. Miller Rentals on Amelia does not assume any responsibility for injuries resulting from your failure to use due caution. Children must be supervised at all times. 

ENTRY: 
Management and Managements representatives and agents have the right to enter the Premises, at any time, (i) for the purpose of making necessary or agreed repairs, decorations, alterations, improvements, for maintenance or to supply necessary or agreed services; (ii) to verify that Guest has complied with the terms of this Agreement; or (iii) in case of emergency. Management and Managements representatives and agents have the right to enter the Premises, upon reasonable notice of at least 24 hours, to show the Premises to prospective or actual purchasers, tenants, mortgagees, lenders, appraisers or contractors.

PERSONAL PROPERTY AND INJURY: 
(i) Owner Insurance: Guest personal property, including vehicles, are not insured by Owner or, if applicable, HOA, against loss or damage due to fire, theft, vandalism, rain, water, criminal or negligent acts of others, or any other cause. Owner/Management does not insure against personal injury to Guest, guests or licensees due to any reason other than the condition of the Premises. (ii) Guest Insurance: Management recommends that Guest carry or obtain insurance to protect Guest and licensees and their personal property from any loss or damage. (iii) Indemnity and Hold Harmless: Guest agrees to indemnify, defend and hold harmless Owner and Management from all claims, disputes, litigation, judgments, costs and attorney fees resulting from loss, damage or injury to Guest or licensees or their personal property.

MEDIATION: 
Guest agrees to mediate any dispute or claim arising out of this Agreement, or any resulting transaction, before resorting to arbitration or court action. Mediation fees, if any, shall be divided equally among the parties involved.

JOINT AND INDIVIDUAL OBLIGATIONS: 
If there is more than one Guest, each one shall be individually and completely responsible for the performance of all obligations under this Agreement, jointly and individually with every other Guest.

IDEMNIFICAION AND HOLD HARMLESS
While Miller Rentals on Amelia and its property owners strive to maintain vacation properties in the finest condition, no guarantees are expressed nor implied regarding suitability or for any particular purpose. All guest(s) and their invitees use the vacation property structures and premises at their own risk. Miller Rentals on Amelia and its property owners shall not be held liable or otherwise responsible in any way for injury to any guest and/or their invitees that is caused or permitted to be caused by the intentional or unintentional acts of said guest(s) and/or invitees, or by the failure of structures, appliances, (including hot tubs and bbqs) furnishings, and/or other equipment, whether by malfunction, misuse, acts of god/nature, and/or are otherwise naturally occurring. No guarantees are expressed nor implied as to the suitability of utilities and other services provided to the vacation properties and adjacent structures and premises. No guarantees are expressed nor implied regarding the suitability/compatibility of materials utilized in the construction of the vacation property and/or its contents. Miller Rentals on Amelia and its property owners shall not be held liable nor otherwise responsible in any way for allergic reactions to guest(s) or invitees, caused or permitted to be caused by materials utilized in the manufacture of the vacation property and/or its contents, nor from mold and/or airborne spores, nor from pet/animal allergens, nor from chemical agents including, but not limited to appliances, linens, carpeting, utensils, fixtures, hot tubs, and/or other equipment. By written or electronic endorsement of this agreement, guest(s) and invitees hereby agree to forever hold-harmless and indemnify Miller Rentals on Amelia and its property owners from and against all claims, demands, loss, liability/responsibility of any kind and character, including cost of defense, arising out of or in any way connected with the guest(s) use of the property.
